Terms and Conditions

  • The term of the plan is one (1) year.
  • The “unit covered under plan” is the (heater/air conditioner/heat pump/GEO unit) on which maintenance is performed under this agreement. If there are multiple heaters or air conditioners, you will be required to specify which unit(s) you want coverage applied to.
  • It is up to the customer to schedule annual maintenance/cleaning during the months of April 1st – Oct 1st for heating and April 1st – June 1st for A/C. Any units not operating due to being dirty/plugged will be charged at a higher service rate for after business hour (8am-4pm, Mon-Fri) calls.
  • The “covered unit” does not include related equipment such as humidifiers, zone valves, electronic air cleaners, distribution ducts, piping, fuel lines, oil tanks, or the electrical service.
  • The 12% discount will be applied to our prevailing fees for parts and labor to perform any repairs to the covered unit. The discount does not apply to the purchase of replacement equipment.
  • We have the right to refuse service if any conditions present are a safety risk or may cause harm to our technicians.
  • Payment for this agreement is due either in full, or according to the terms already agreed upon. This agreement is not valid until payment is received, and it is non-refundable.
  • This plan supersedes all prior service plans.
  • The plan will be void if you obtain service from others, refuse repairs needed for safe operation, attach incompatible devices to the system, or fail to comply with our credit terms.
  • The discount offered in our Plus Packages is based on current rate or flat rate pricing. New equipment is not covered by this discount.
  • Plus Package customers earn CMS reward credits. Credits are accumulated only in CONSECUTIVE years and may only be used towards replacement of the equipment that is currently under coverage.
  • The plan does not cover any parts on your heater/air conditioner/heat pump/GEO unit other than parts named in the service plan. Although we do warranty any parts that we replace up to one (1) year.
  • You must use normal care in operating the equipment including: making sure there is water in the boiler, flushing the low water cut off, checking switches and fuses, and arranging regular inspections during periods of absence.
  • Pertaining to our Oil Heat customers: CMS is not responsible for fouling due to use of dirty fuel or non-heating fuel.
  • Oil customers: Basic filters only, are included in the package. Screw on filters & tiger loop filters are an additional cost.
  • Refusal of recommended repairs may lead to failure of unit, and may affect any applicable warranties on equipment, and is not the responsibility of CMS.
  • Priority emergency service allows our (program enrolled customer) preferred emergency service scheduling during business hours (6am-11pm, Mon-Sun. (*Unless during times of extreme dangerous outside temperatures.)
  • Breeching must be accessible for cleaning. Chimney cleaning is not included.
  • If lack of fuel is the reason for unit not operating, a service call charge will be issued. A service call charge may also be issued if it is necessary to return after the delivery of fuel.
  • The agreement covers repairs due to normal wear. Repairs for other reasons (including fire, water, abuse, freezing, lightning, lack of electricity, vandalism, tampering, unusual operations, acts of God, etc.) are not covered.
  • Plus Plans limited to one (1) of each included part per service plan year.
  • Price of package labor associated with chosen package. Systems needing longer time to clean heat exchanger, due to conditions other than normal, will be charged accordingly.
  • This agreement does not guard against equipment failure.
  • This agreement does not include high-voltage electrical connections and related parts to units.
  • This agreement does not cover any repair or replacement of any inaccessible refrigeration lines or electrical wiring.
  • The agreement does not cover any ductwork or other item that may deteriorate due to corrosion, age, poor installation, or bad duct design.
  • CMS shall provide all the material and labor to perform the scheduled maintenance outlined in your service package.
  • CMS is not responsible for removal or disposal of any hazardous materials or mold.
  • CMS’s maximum liability, based upon any claim or cause of action, shall not exceed the annual amount of this agreement.
  • This agreement does not cover any repairs or maintenance not specifically covered by this agreement. We will obtain written authorization for any repairs not covered in this agreement before the work is performed.
  • CMS reserves the right to modify or cancel the program and/or refuse service to specified HVAC equipment in the event that you are in violation of terms hereof; or if you commit any act of fraud or misrepresentation; or if the condition of HVAC equipment is in violation of any applicable building codes.
